Maintain 1 Lane OP side
I was finally able to get a hold of the OP claims adjustor today and
now everything makes sense. Here is their side of the story: "We were making a left hand turn into the shopping center. It was bumper-to-bumper traffic and the two lanes waved us through. When I got to the third lane I looked and no car was coming. I was almost in the shopping center when I heard the crash and the back of my car was thrown into a pole." Doesn't that sound like the same story I was telling? But wait there's more. This is what three different witnesses told the cop (which I was not told about). First witness: "the girl was speeding and slammed into his rear-end" (how could I be speeding in bumper to bumper traffic when the speed limit is already fifty?) Second witness: "the BMW hit her which made her hit the OP car" (never happened). Third witness: "she swerved from the middle lane out into the right lane and clipped his tail end" (this one now explains the ticket) So needless to stay, I still don't have the police report because it hasn't been filed yet. Once I get it then I will post what it says. My main issue now is proving that I was in the right hand lane the whole time. I think that the damages to their vehicle show that I was obviously coming down the right hand lane; if I moved from the middle to the left I would probably have some type of front end damage which I don't. Just wanted to give an update. Thanks to everyone who has responded with their opinions and advice. |

Well, this makes a lot more sense now. The driver you hit is STILL 100% at fault in this situation. Unfortunately, you have a witness against you. I wish you the best.
