This was voluntary but i say make it mandatory. People are searched when they try to get on a plane or enter a govt building, a aren't they?. Drunk drivers are killers and i don't want them coddled.

The request was part of a government research study aimed at determining the number of drunken or drug-impaired drivers. "It just doesn't seem right that you can be forced off the road when you're not doing anything wrong," said Kim Cope, who said she was on her lunch break when she was forced to pull over at the roadblock on Beach Street in North Fort Worth. The National Highway Traffic Safety Administration, which is spending $7.9 million on the survey over three years, said participation was "100 percent voluntary" and anonymous. But Cope said it didn't feel voluntary to her -- despite signs saying it was. "They were asking for cheek swabs," she said. "They would give $10 for that.. Also, if you let them take your blood, they would pay you $50 for that." |

A cop has to have "reasonable cause" to assume you are under the influence. Cops can't just tell you to stop for any reason then demand you "volunteer" to take tests which could result in your arrest. Then they surely can't bust you because you refused to volunteer. |

Agreed but there is a big misunderstanding throughout this thread. It is not a DWI checkpoint. It is a study to determine how many people under the influence are on the road: "Some drivers along a busy Fort Worth street on Friday were stopped at a police roadblock and directed into a parking lot, where they were asked by federal contractors for samples of their breath, saliva and even blood. It was part of a government research study aimed at determining the number of drunken or drug-impaired drivers" The cops where there only to "assist" and traffic control. (sure they were LOL) As such their "volunteer" part winds up testing only the sober ones and those too bombed to understand what is going on as well as ones who don't know their rights. The "volunteer" part is obviously wrong also. Joe blow who has had a few too many "volunteers" - test finds him beyond the limit. Suuurrreee the tester is going to let him get back on the road. I also believe in the easter bunny. Bottom line: Any results they get are worthless due to that self selection bit. Harry K |

I guess they were watching people and if you signaled your turns and such they would select you. If my memory is correct someone took them to court over being stopped and the court ruled that even if the cops where honestly trying to simply be nice and hand out gift cards it was illegal for them to do this as they had no probably cause to stop you. I think it was a state court. I suspect our schizophrenic US supreme court would say it was OK since they almost always bend over for the cops. |

They didn't want accurate data regarding BAC or anything else regarding the driver's condition. If they were testing anything it was the reaction of the people. Would they resist? Would they say no? That's the data of interest. |

Convincing people to set aside their rights is a long standing way governments operate. They are powerless if enough people tell them to get stuffed. Their power is in the perception. Once a critical mass no longer believes them whatever they are doing will fail. Alternatively, there could be a critical mass of people who don't believe the government but think they are a tiny minority. When they realize they aren't the game is over. So sometimes it's just pure social pressure where those who would resist don't want to be the only person who does. |
