Indeed - so going back a bit, is the driver still responsible for those particular
accidents caused by those tyres failing ?

Correct. You could argue that the driver isn't responsible. But it's still
a tire failure related to poor vehicle maintenance. For the most part,
tires on properly maintained vehicles don't blow, unless they are
bridgestone/firestone. -Dave
