I don't see why not. For example, running a red light and crashing a 4000
pound hunk of steel into another car is the same as tossing a bomb at them.

If that is their designed intention, then they should be treated as
such. If there are other factors involved, they need to be
considered.
(Your weight factor may also be involved.)
If someone is standing behind the target at a rifle range and gets
killed, should the shooter be charged?
We'll have to take into account the bomb, too. <g>
