An illegal immigrant charged in a deadly hit-and-run crash bonded out of a
Colorado jail and avoided detention by federal immigration agents over the weekend. Ivan Zamarripa-Castaneda, 26, fled the scene of an accident on Interstate 70 involving a tractor-trailer that caught on fire last week, leaving the driver to die, according to the Denver Police Department. The Denver County Sheriff's Office said in a statement Zamarripa-Castaneda posted a $25,000 bond on Saturday and was released from Denver’s Downtown Detention Center at 5:28 p.m. The law enforcement agency said although the department alerted ICE in response to a request for release notification it received, that alert did not occur until 6:33 p.m. Less than two hours afterwards, ICE deportation officers arrived at the sheriff’s office to have Zamarripa-Castaneda transferred to ICE custody, only to be told that he had already been released. On "America's Newsroom," Fox News senior judicial analyst Judge Andrew Napolitano said it's "inconceivable" that any bail was set at all, because there was a death involved and Zamarripa-Castaneda fled the scene. "It was profoundly wrong to give bail at any amount to a person who's a danger to the society," he explained. "They really have to find him now." He noted that this did not occur due to Denver's sanctuary city policy, but instead because of a "breakdown in communication." "This is a sheriff who did want to put this guy in federal custody, because the sheriff disagreed with the bail," Napolitano said. "He had no choice but to honor it. He didn't want this guy on the streets. Now he's loose on the streets, probably to drive a motor vehicle again."
